ESCLARECIMENTO DO CAPELÃO GERAL R.I.S.M.A. SOBRE O ACORDO "ORDEM DE SÃO MIGUEL DA ALA"


 Na sequência do acordo alcançado e assinado em Lisboa, a 7 de Agosto de 2023 por Dom Nuno Maria de Bragança e Bourbon de Figueiredo Cabral da Câmara Pereira (nome tal como consta no Cartão de Cidadão), Dom Francisco José Senra Coelho, Dom Manuel António Mendes dos Santos, e o advogado Dr. João Sardinha, representando os demais partidos, Foi convidado a H.R.H. D. Duarte de Bragança a assinar pessoalmente uma cópia do acordo tendo-o feito como sinal de boa fé, no dia 15 de Agosto, durante o almoço onde foi convidado a participar.

ESCLARECIMENTO A TODOS OS MEMBROS DA ORDEM DE SÃO MIGUEL

A - Sobre a Associação Civil O.S.M.A., a R.I.S.M.A. e o Acordo na Disputa de Direitos Autorais sobre a Denominação e Símbolos da Ordem de São Miguel da Ala:

1. A Real Ordem de São Miguel da Asa (R.O.S.M.A.) é uma Ordem Real Dinástica Portuguesa Católica instituída pelo primeiro Rei de Portugal Dom Afonso Henriques em 1147 e aprovada pelo Papa Alexandre III em 1181. É hoje sob a Igreja Católica Romana, seus membros fazendo parte da Irmandade Real de São Miguel da Asa (R.I.S.M.A.), Associações Diocesanas dos Fiéis erigidas Canonicamente, únicas beneficiárias de fundos unidos sob uma Federação R.I.S.M.A. que reconhece H.R.H. Dom Duarte Pio de Bragança, como Chefe da Casa Real Portuguesa e único Grão-Mestre Hereditário das Ordens Reais Dinásticas, reconhecido como tal pelo H.H. o Papa no Decreto do Ano Jubileu concedido em 2020 pelo 850º Aniversário da Ordem.

2. A Ordem de São Miguel da Ala (O.S.M.A.) é uma associação civil criada em notário público por um grupo de membros da Ordem em 1981. Era para servir como uma associação secular pública de caridade para fornecer fundos para a A.S.A. (Associação Socorro e Amparo), uma casa infantil em Sintra apoiada pelos seus membros. Esta associação civil reconheceu H.R.H.D. Duarte Pio de Bragança como um grande benfeitor da A.S.A. tendo sido “Grande Mestre” que significa “Presidente da Junta de Assembleia” numa altura em que o Presidente do Conselho de Administração era chamado de “Chanceler”. Isto na associação civilmente constituída.

3. Alguns membros da Associação Civil O.S.M.A. discordaram da criação do R.I.S.M.A. em 2000 para ser o único elogio social dos membros, e assim reativaram a mesma associação depois de H.R.H. o Duque de Bragança ter ordenado que cessasse toda a a atividade a partir de 1995 em antecipação à criação da associação canonicamente erguida.

4. A Associação Civil O.S.M.A. procedeu em 2001 ao registo do nome e símbolos tradicionais da Ordem de São Miguel da Asa como marcas comerciais protegidas por direitos de autor.

5. Ao mesmo tempo, agora falecidos associados do Duque de Bragança à frente de outras organizações associadas ou representativas da sua pessoa, criaram também num Notário público, uma associação civil denominada “Real Ordem de São Miguel da Ala”, e registaram os símbolos idênticos a seu favor justificando o seu uso contínuo pela Casa Real e pela Igreja Católica com direitos aderentes adquiridos ao longo dos séculos, dando assim origem a uma disputa legal sobre o nome e símbolos que se manteve nos Tribunais durante mais de 20 anos com uma ou outra parte tendo ganho ou perdido, vários casos como relatado na imprensa.

6. Em 2022, a R.I.S.M.A. Portuguesa da Arquidiocese Évora foi criada pelo Arcebispo como a única Associação Canonicamente Erguida dos Fiéis em Portugal. Registou o nome e os símbolos pertencentes à Ordem, tendo, assim, sido também processado pela Associação Civil O.S.M.A.

7. Em Junho de 2023, antes de um Julgamento referente a uma ordem de restrição apresentada num dos vários casos, foi uma proposta de Resolução Fora do Tribunal e Reconciliação entre H.R.H. o Duque de Bragança e o seu primo; Dom Nuno da Câmara Pereira, presidente da Associação Civil O.S.M.A. recebido alegremente pela Cúria da Federação R.I.S.M.A. e pelo próprio Dom Duarte Pio de Bragança.

8. Seguiram-se negociações nos próximos meses, entre a Cúria do R.I.S.M.A., a Associação Civil O.S.M.A. e o Dr. João Sardinha, o representante legal do Duque de Bragança e as outras partes detentores de direitos de autor registados semelhantes que também foram processados; o Arcebispo e Arquidiocese de Évora, o R.I.S.M.A. de Évora, e duas fundações.

9. No dia 7 de Agosto de 2023, foi finalmente alcançado um acordo pelas partes acima mencionadas sobre o uso do nome protegido por direitos de autor e símbolos da Ordem de São Miguel da Asa.

10. Tendo em conta o registo de direitos de autor sobre os símbolos tradicionais da Ordem de H.R.H. o Duque de Bragança foi recentemente declarado "nulo e sem efeito" pelo Tribunal como foi a associação civil "Real Ordem de São Miguel da Ala". Isso aconteceu por falta de uso comercial durante os primeiros quatro anos após o registro, como a lei exige. Uma vez declarados "Null and Void", estes registos passaram automaticamente para o segundo titular dos direitos de autor registado, a saber, a Associação Civil O.S.M.A. Ordens de Restrição Legais tinham sido apresentadas pela Associação Civil O.S.M.A. em vários processos judiciais e estes mantiveram continuamente o Duque de Bragança de utilizar comercialmente os símbolos durante 15 anos até que finalmente ele ganhou o caso sobre o registo desses símbolos, posteriormente declarados como dele. Infelizmente, nessa altura, passaram-se demasiados anos e era demasiado tarde para continuar a deter os direitos de autor porque a não utilização durante os primeiros quatro anos foi comprovada. O Tribunal ficou indiferente ao impedimento legal que havia ditado e antipático à situação que impediu legalmente Dom Duarte de Bragança, o proprietário dos direitos de autor, de utilizar os símbolos comercialmente. Nem aceitou o argumento de que Dom Duarte havia autorizado outros a utilizar comercialmente os símbolos em seu nome durante este período.

11. Anteriormente, a Associação Civil O.S.M.A. também havia perdido e perdido o registo do mesmo símbolo ao Duque de Bragança e também por não ter comprovado o uso comercial dos símbolos durante os primeiros quatro anos após o seu registo.

12. Tendo em conta o acima exposto, o Acordo alcançado e assinado pela Cúria da R.I.S.M.A., Associação Civil O.S.M.A. e Dr. João Sardinha actuando como representante legal do Duque de Bragança e das demais partes, visava acabar com todas as batalhas jurídicas no curso e evitar futuras processos judiciais. Foi decidido que todos os titulares dos direitos de autor iriam transferir os símbolos da Ordem para a Associação Civil O.S.M.A. e que o R.I.S.M.A. da Arquidiocese de Évora, representado pelo seu Arcebispo e pela Arquidiocese, mudaria o nome e os símbolos do R.I.S.M.A., o Bispo Mediador propondo que todas as outras onze Associações Canónicas e Civis da Federação R.I.S.M.A. também fazem o mesmo.

CLARIFICATION TO ALL MEMBERS OF THE ORDER OF SAINT MICHAEL

A - Regarding the O.S.M.A. Civil Association, the R.I.S.M.A. and the Agreement in the Copyright Dispute over the Denomination and Symbols of the Order of Saint Michael of the Wing:

1. The Royal Order of Saint Michael of the Wing (R.O.S.M.A.) is a Catholic Founded Dynastic Portuguese Royal Order instituted by the first King of Portugal Dom Afonso Henriques in 1147 and approved by Pope Alexander III in 1181. It is today under the Roman Catholic Church, its members being part of the Royal Brotherhood of Saint Michael of the Wing (R.I.S.M.A.), independent Canonically Erected Diocesan Associations of the Faithful, sole beneficiaries of funds united under a R.I.S.M.A. Federation that recognizes H.R.H. Dom Duarte Pio de Bragança, as Head of the Portuguese Royal House and sole Hereditary Grand Master of Dynastic Royal Orders, recognized as such by the H.H. the Pope in the Decree of the Jubilee Year granted in 2020 for the 850th Anniversary of the Order.

2. The “Ordem de São Miguel da Ala (O.S.M.A.) is a civil association created in a public notary by a group of members of the Order in 1981. It was to serve as a public charitable secular association to provide funds for A.S.A. (Associação Socorro e Amparo), a Children’s home in Sintra supported by its members. This civil association recognized H.R.H. D. Duarte Pio de Bragança as a major benefactor of A.S.A. having been “Grand Master” meaning “President of the Assembly Board” at a time when the President of the Board of Directors was called “Chancellor”. This in the civilly constituted association.

3. Some members of the O.S.M.A. civil association disagreed with the creation of R.I.S.M.A. in 2000 to be the sole social compliment for members, and so reactivated the same association after H.R.H. the Duke of Bragança had ordered it to cease all activity as of 1995 in anticipation of the creation of the canonically erected association.
4. The O.S.M.A. civil association proceeded in 2001 to register the traditional name and symbols of the Order of Saint Michael of the Wing as copyrighted commercial trademarks.

5. At the same time, now deceased associates of the Duke of Bragança at the head of other organizations associated or representative of his person, also created in a public Notary, a civil association named “Real Ordem de São Miguel da Ala”, and registered the identical symbols in their favor justifying their continued use by the Royal House and the Catholic Church with adherent rights acquired over the centuries, and thus giving origin to a legal dispute over the name and symbols that has continued in the Courts for over 20 years with one or another party having won or lost, multiple cases as reported in the press.

6. In 2022, the Portuguese R.I.S.M.A. of the Archdiocese Évora was created by the Archbishop as the only Canonically Erected Association of the Faithful in Portugal. It registered the name and symbols pertaining to the Order, thus having also been sued by the O.S.M.A. civil association.

7. In June of 2023, prior to a Trial regarding a restraining order filed in one of the various cases, a proposal for an Out of Court Settlement and Reconciliation between H.R.H. the Duke of Bragança and his cousin; Dom Nuno da Camara Pereira, President of the O.S.M.A. civil association, was joyfully received by the Curia of the R.I.S.M.A. Federation and by Dom Duarte Pio de Bragança, himself.

8. Negotiations followed over the next few months, between the Curia of the R.I.S.M.A., the O.S.M.A. civil association and Dr. João Sardinha, the legal representative of the Duke of Bragança and the other parties holding similar registered copyrights who were also sued; the Archbishop and Archdiocese of Évora, the R.I.S.M.A. of Évora, and two Foundations.

9. On August 7th, 2023, an Agreement was finally reached by the aforementioned parties over the use of the copyrighted name and symbols of the Order of Saint Michael of the Wing.

10. Given the copyright registration on the traditional symbols of the Order held by H.R.H. the Duke of Bragança was recently declared “null and void” by the Court as was the “Real Ordem de São Miguel da Ala” civil association. This happened because of lack of commercial use during the first four years following registration, as the law demands. Once declared “Null and Void”, these registrations passed automatically to the second registered copyright holder namely the O.S.M.A. civil association. Legal Restraining Orders had been filed by the O.S.M.A. civil association in various lawsuits and these had continually kept the Duke of Bragança from commercially using the symbols during 15 year until he finally won the case over the registration of those symbols, subsequently declared to be his. Unfortunately, by then, too many years had passed and it was too late to continue to hold the copyright because non-use during the first four years was proven. The Court was indifferent to the legal impediment it had dictated and unsympathetic to the situation that legally impeded Dom Duarte de Bragança, the copyright owner, from using the symbols commercially. Neither did it accept the argument that Dom Duarte had authorized others to commercially use the symbols on his behalf during this period.

11. Previously, the O.S.M.A. civil association had also lost and forfeited their registration of the same symbol to the Duke of Bragança and also for not having proven commercial use of the symbols during the first four years following their registration.

12. In view of the above, the Agreement reached and signed by the Curia of the R.I.S.M.A., O.S.M.A. civil association and Dr. João Sardinha acting as legal representative of the Duke of Bragança and the other parties, was intended to end all of the legal battles in course and avoid future lawsuits. It was decided that all copyright holders would transfer the symbols of the Order to the O.S.M.A. civil association and that the R.I.S.M.A. of the Archdiocese of Évora, represented by its Archbishop and the Archdiocese, would change the name and symbols of the Portuguese R.I.S.M.A., the Mediator Bishop proposing that all of the other eleven R.I.S.M.A. Federation Canonical and Civil Associations, also do the same.

B – Regarding the Agreement on the use of Denominations and Symbols and changes that may affect the Members of the Dynastic Order and R.I.S.M.A.:

1. As per the Agreement, the new sole copyright holder on the traditional name and symbols of the Order, is the O.S.M.A. civil association which will allow all persons decorated with the Dynastic Order of Saint Michael of the Wing, granted through the R.I.S.M.A., up until August 7th, 2023, to continue to use the old symbols on Insignia and Capes at public, religious events organized by the R.I.S.M.A. Federation Partners (within the European Union) BUT ONLY IF said members register as “Honorary Members” of the O.S.M.A. civil association and contribute with 100.00 € per year in dues, an amount which will be divided with the respective R.I.S.M.A. canonical association to which each member belongs.

2. The Catholic Dynastic Royal Order attributed up until now through the R.I.S.M.A. will be publicly known as per the Commercial Forum of Copyrights, as the “Royal Order of the Archangel Saint Michael” and adopt the symbol of the R.I.S.M.A. of the Archdiocese of Évora. This is one of several historic symbols of the ancient Order dating from 1848. The other ancient symbols of the Order depicting a winged arm holding a sword, are to be used by the Delegations of the Order under the Cistercian and Benedictine Monasteries, in Spain, Italy and Brazil and also by the Military Archdiocesan R.I.S.M.A. in the USA and Ukraine.

3. Members of the Order of Saint Michael of the Wing with diplomas issued before August 7th, 2023, DO NOT need to substitute or receive a replacement diploma. Neither do they need to change their insignia, unless, as mentioned in Nº 2, they want to wear these symbols at R.I.S.M.A. events in Europe. In this case they must register with the O.S.M.A. civil association as “honorary members” and contribute with yearly dues. If they do not want to join this association and contribute with dues, then they have to change the insignia and cape patches for the respective symbol of the R.I.S.M.A. they belong to, acquiring the respective embroidered patches and neck insignia from the Secretariat of their canonical association.

4. Those members of the Order of Saint Michael of the Wing who were decorated with the Insignia for Merit and this includes the Judges, Members of the Curia, Delegates and other entities decorated by H.R.H. the Duke of Bragança, are exempt from the contribution of dues.

5. All future attributions of the Order of Saint Michael of the Wing, if any, using the traditional symbols on insignia, capes and diplomas, will require that the proposed recipients register with the O.S.M.A. civil association as “honorary members” contributing with the Passage Fee to be stipulated, which will be divided with the respective R.I.S.M.A. canonical association to which the new member will belong.

6. Alternatively, under the Patronage of the Portuguese Royal House, new Catholic, Dynastic Royal Orders of Merit dedicated to the Archangel Saint Michael, as Angel of Portugal and of Peace, will be canonically instituted by each of the twelve Diocesan R.I.S.M.A. using the respective symbols. These will be conferred in the traditional ranks of Orders of Chivalry. These new Orders of Merit of the Royal Brotherhoods are Ecumenical and can be attributed to anyone.

C – Regarding the Relationship between the Duke of Bragança and the O.S.M.A. Civil Association:

1. Given his history with the O.S.M.A. civil association, the President of the Board of said association (who is styled in the Statutes as “Grand Master”), has granted H.R.H. the Duke of Bragança, Hereditary Grand Master of the Dynastic Orders of the Portuguese Royal House, the style of “Honorary Grand Master”, in this case meaning “Honorary President of the Board” of the said O.S.M.A. civil association, allowing for H.R.H. to personally use all ancient copyrighted Symbols and Insignia of the Order of Saint Michael of the Wing without any impediment.

2. H.R.H. the Duke of Bragança is however, obligated by the Agreement reached between his Lawyer, the O.S.M.A. civil association, the Archbishop and Archdiocese of Évora, the R.I.S.M.A. of Évora and mediated by Bishop D. Manuel António Mendes dos Santos, to remove “Royal Patronage” and not attend events of any R.I.S.M.A. canonical association, that chooses not to abide by the proposed reform to change its name and symbols to those agreed upon between the R.I.S.M.A. Curia and the O.S.M.A. civil association. This obligation is especially aimed at the R.I.S.M.A. outside the EU not legally obligated to abide by the Agreement; namely the canonical associations of the Archdiocese for Military Services (AMS), of the Ukraine Archdioceses and Military Delegation, of the U.K. and Commonwealth Delegation, of the Canadian Military Delegation and of the Brazilian Benedictine Abbey and the Military Delegation for Brazilians in Florida, all of whose legal registered names are in the Portuguese version: “Real Ordem de São Miguel da Ala” and each of which have also copyrighted the traditional symbols of the Order of Saint Michael of the Wing in their respective countries. All R.I.S.M.A. canonical associations and O.S.M.A. civil associations are asked to implement the proposed changes and sign the Federative Charter of Reform to be presented in Alcobaça, on September 29th, 2023.

3. Although the Duke of Bragança had no personal involvement in the Agreement reached between the Court appointed Mediator Bishop Dom Manuel António Mendes dos Santos, Chaplain General of the R.I.S.M.A. Federation, the Archbishop of Évora Dom Francisco José Senra Coelho, the Archdiocese of Évora, the R.I.S.M.A. of Évora Archdiocese, the two legal representatives of the O.S.M.A. civil association and Dr. João Sardinha, the legal representative of the Duke of Bragança and of the other parties involved, given he was not present at the preparatory meetings, nor at the signing of the Agreement on August 7th, 2023, Dom Duarte de Bragança did however, sign a copy of the same agreement, at a later date, as requested for the archive of the O.S.M.A. civil association by its Board President during a recent lunch with Dom Nuno da Câmara Pereira. This was intended as a gesture of good faith and a sincere desire of the Duke of Bragança to see an end all of these legal battles.

The Canonical and Civil Legal Team of the Association of Knights and Dames of the Portuguese Royal House

D – Regarding the O.S.M.A. Civil Association, it’s Members and the R.I.S.M.A.:

1. The O.S.M.A. civil association, at times claims to be the ancient, Catholic founded Order of Saint Michael of the Wing, whilst at other times, maintains that the ancient Order never existed before its legal creation in a Portuguese Notary in 1981. The same today O.S.M.A. civil association is currently NOT affiliated in any with the Dynastic Orders or Order of Merit attributed through the R.I.S.M.A.

2. In keeping with the International Commission of Orders of Chivalry (I.C.O.C.) recognition, only members of the Order of Saint Michael of the Wing belonging to the O.S.M.A. civil association who were decorated between 1981 and 2000 and not expelled from the R.I.S.M.A. or interdicted by the Curia of the R.I.S.M.A. for Statutory or Canonical Infractions are NOT considered members of a Fantasy Order.

3. Those persons decorated by the O.S.M.A. civil association after 2000, and who had not joined or integrated the R.I.S.M.A., through the “Pardon of Saint Michael” (Granted by the Curia during the 2020 - 2022 Jubilee Year) are regarded as members of a Fantasy Order.

4. This is a situation that is maintained given the organization at present DOES NOT Nwish to be involved with the R.I.S.M.A. Federation as a “Protocol Partner” so as to receive “Royal Patronage” and “Ecclesiastic Fons Honorum”.

5. Only integration in the R.I.S.M.A. Federation as a “Protocol Partner” can grant the O.S.M.A. civil organization a “Chaplaincy Service” for celebration of Mass for its groups, given that at present this civic association is laical and as such canonically impeded from holding investitures with masses in sacred places of Catholic worship.
